Action by the plaintiff Riteway Builders, Inc., on an insurance policy issued by the defendant First National Insurance Company of America to recover damages caused by the collapse on November 14, 1957, of a basement wall of the plaintiffs building. The plaintiffs claim was refused and this action was commenced some five years later, on August 30, 1962. In bar of the action the answer pleads the provisions of the policy limiting the time within which a suit may be commenced to twelve months after inception of the loss. From an order overruling the demurrer to the answer, the plaintiff appeals. It was stipulated on appeal the coverage against the peril of collapse was provided by an endorsement attached to a standard fire insurance policy form.
